1. Who we are

Markadis is a sole trader registered in Bussum, the Netherlands (Chamber of Commerce no. 42106101). We are the data controller under the General Data Protection Regulation (GDPR) for any personal data we process through this website.

For questions about your personal data, contact us at [email protected].

2. What data we collect

We only process personal data that you actively submit to us via the contact form on this website. This includes:

  • Name
  • Company name
  • Email address
  • Country of origin
  • Product category
  • The content of your message

We do not collect data via cookies, trackers, or analytics tools. No cookies are placed on this website that track your browsing behaviour.

Fonts and other external services

The typefaces and photographs on this website are served from our own server. Your browser makes no request to Google Fonts, to a content delivery network, to an image host, or to any other third party in order to display a page here, so no record of your visit reaches them. The one exception is the spam protection on the contact page, described below.

Spam protection on the contact form

The contact form is protected by Cloudflare Turnstile, a service of Cloudflare, Inc. that tells people from automated programs without a puzzle to solve. When you open the contact page, and only that page, your browser loads this check from Cloudflare. To carry it out Cloudflare processes your IP address and technical information about your browser and device. It is used solely to protect the form against abuse, not for advertising and not to follow you across websites. Cloudflare may process this data outside the European Economic Area, under the EU–US Data Privacy Framework and standard contractual clauses. More information: cloudflare.com/privacypolicy.

3. Purposes of processing

We process your personal data solely to:

  • Confirm by email that your enquiry has reached us;
  • Respond to your enquiry and provide a written assessment of your brand's prospects in the Dutch market;
  • Protect the contact form against automated abuse;
  • Follow up if you wish to discuss a potential collaboration;
  • Carry out our services correctly once an agreement is in place.

We do not use your data for commercial mailings or newsletters without your explicit consent.

4. Legal basis

The processing of your personal data is based on:

  • Legitimate interest (Art. 6(1)(f) GDPR): responding to business enquiries and conducting pre-contractual communication;
  • Performance of a contract (Art. 6(1)(b) GDPR): once a service agreement is in place;
  • Legal obligation (Art. 6(1)(c) GDPR): where required by law, such as financial record-keeping.

5. Retention periods

Enquiry data from non-clients is kept for a maximum of twelve months after the last communication, unless a business relationship is established. The copy of each enquiry held on our web server is deleted automatically twelve months after it was submitted.

Data relating to clients is retained for the duration of the business relationship and for seven years thereafter, in line with Dutch statutory record-keeping requirements.

6. Sharing with third parties

We do not share your personal data with third parties without your consent, except where:

  • it is necessary to fulfil a contract (e.g. logistics partners, payment service providers);
  • we are legally required to do so;
  • it is necessary to protect our legitimate interests.

Messages submitted via the contact form are handled by our own web server: each message is stored there and sent to our mailbox, and is used solely for internal follow-up. Three service providers are involved in this: the company that hosts our server, the provider of our email, and Cloudflare for the spam protection on the form. They act as processors on our instructions, under a data processing agreement, and may not use your data for purposes of their own. Your data is not sold or passed to anyone else.

7. Your rights

Under the GDPR you have the following rights regarding your personal data:

  • Right of access You can request to see what personal data we hold about you.
  • Right to rectification You can ask us to correct inaccurate data.
  • Right to erasure You can request deletion of your data, to the extent permitted by law.
  • Right to restriction You can ask us to restrict processing.
  • Right to data portability You can request your data in a commonly used, machine-readable format.
  • Right to object You can object to processing based on legitimate interest.

To submit a request, send an email to [email protected]. We will respond within one month. We may ask you to verify your identity before processing a request.

8. Security

Markadis takes appropriate technical and organisational measures to protect your personal data against loss, theft, or unauthorised access. All communication via this website is encrypted over HTTPS.

9. Complaints and supervisory authority

If you believe we are not handling your personal data correctly, please contact us first at [email protected].

You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens), the supervisory authority for data protection in the Netherlands: autoriteitpersoonsgegevens.nl.

10. Changes to this policy

Markadis reserves the right to update this privacy policy. Changes will be published on this page with the date of the most recent revision. We recommend checking this page periodically.
